General Terms of Service

Sites, domains and subdomains at http://www.vimec.biz/en (hereinafter referred to as the Site), are the exclusive property of Vimec Srl, having Registered Office and Operating Unit in: Via Parri 7 - 42045 Luzzara (RE) - Italy (VAT and Tax Code: 00758850358), hereinafter referred to as Vimec.
The Site is not updated periodically and regularly, and therefore should not be registered as an editorial product under the law 47 of 1948.

Acceptance of Terms

These General Terms of Service contain the terms and conditions governing the use of services offered by Vimec. By accepting these conditions during the registration process to the Site, and using the Site, the User expressly agrees to abide by the Terms of the Site.

Changing the Terms

Service conditions may be changed at any time at the final discretion of the owners, when deemed necessary for reasons of a legal or technical nature.
Subject to the ordinary remedies provided by law for breach of obligations under the contract or non-compliance with existing rules, Vimec reserves the right to send notices to the User, suspend services temporarily or permanently, interrupting all or some of its services, in the case of:

  1. violations of these General Terms;
  2. impossibility of the Site to verify the authenticity of the information provided during registration or during use of the service;
  3. carrying out actions that could result in economic harm or legal liability to the Site or other Users;
  4. reasons of safety and prevention of unauthorized access to the Site;
  5. partial or complete cessation of services.

Use of the Site

The User further acknowledges and expressly warrants to use the Site and the services provided in full compliance with the General Terms of Service. The User also acknowledges and expressly warrants that he/she will not violate the rights of any other person, that he/she will not default on any contractual obligation or legal obligation against a third party, and that he/she will not violate the laws in force. The User also agrees explicitly to indemnify Vimec against any liability in respect of any person, arising from use of the site that does not comply with these Terms.
To register for the www.vimec.biz/en site, the use of names of persons or companies as well as an imaginative nickname is allowed, provided that the User has permission to use the name or domain and such use does not violate any of the laws in force concerning intellectual property. By registering on the Site the User agrees to indemnify Vimec against any liability towards any person, arising from the use of personal names, domain names or corporate brands, not in accordance with laws in force.

The User is expressly forbidden, as follows:

  • using the Website in a manner that could damage, put out of service, overload or otherwise impair the operation of the Site or the network(s) to which the Site is connected;
  • engaging in any action that would interfere with or prevent the use of the Site by third parties;
  • attempting access, by any unlawful means to the Site or information and/or data relating to the registered Users and/or computers and networks connected to the Site.

Vimec reserves the right to remove at its sole and final discretion any content that is:

  • unlawful, defamatory, racist or slanderous;
  • instigating hatred or violence;
  • detrimental to persons, institutions or religions;
  • detrimental to another's privacy;
  • harmful to minors;
  • detrimental to trademarks, patents and content protected by copyright;
  • containing personal data of third parties;
  • promoting business.

In case of suspension, temporary or indefinite period, the User may not register again with the same credentials associated with the suspended account.

Content ownership

Unless otherwise indicated, the Site, its graphics, and all text, images, trademarks, logos and everything on the Site is owned by Vimec, and all rights are reserved.
Vimec, vimec.biz/en, the logo and all other marks on the Site are registered trademarks or in any case belonging to Vimec, or to third parties who have expressly granted the use of the mark. Nothing contained on the Site may be construed as a warranty, implied or otherwise, of any license or right to use the trademarks without the prior written consent of Vimec or other party who is a holder of the trademark.

These rights are protected by laws and international treaties applicable in the field of intellectual property protection, and, any form of reproduction and redistribution, even partially, of the layout and graphics of the Site, and other contents present in it, is therefore prohibited, as well as punished civilly and criminally, without the prior written consent of Vimec.

The contents of any kind (text, images, video, etc.) provided and released by the Users, shall remain the exclusive property of the Users and/or third parties from which the User has obtained the rights to use. By submitting such content, the User grants the Site the right to use, publish, disclose, copy, transmit, display, publicly perform, the contents.

The User states and warrants that submitting the contents and/or their use by the Site will not infringe any intellectual or industrial property rights and/or image rights and/or the right to privacy and/or the right to privacy of third parties. In particular, the User states and warrants having obtained all necessary consents and approvals from any third parties concerned, that fees and charges payable by law or contract have been paid to third parties and that no right of third parties prevents the Site from receiving and using the contents in accordance with the General Terms.

Consequently, the User agrees to indemnify and hold harmless Vimec from any and all claims, damages, injury, cost or expense (including the costs for legal assistance as well as those resulting from any court order issued against the Site) if involved as a result of the User's violation under this paragraph.

Warranty Disclaimer and Limitation of Liability

To the extent permitted by law and subject to the rights of consumers, Vimec makes no guarantee about the content of the website, for any purpose, except as otherwise provided for paid services.
It also does not assume any guarantee as to the accuracy or the exclusive character of the site content, in particular of the content entered by Users personally.

The User uses the Site at his sole responsibility, and Vimec, except for the services provided for a fee with the sole aim of the service itself, may not be liable, provided for under contract or not provided for under contract, for any loss or damage arising from the use of the Site, including, without limitation, any damages (direct, indirect, punitive or consequential) and any loss (income, profits, goodwill, data, contracts, use of money), as well as loss or damage arising from business interruption resulting from use or inability to use or the results of the use of this Site.

International Users

Vimec does not guarantee that the information on the Site is correct, and, in particular, that the contents are available with the same appearance, in the same format and the same conditions even outside Italy. The User, residing in a country other than Italy, visiting and using the Site, agrees to comply with all applicable laws regarding the transmission of data and content in the country in which he is resident and, if downloading information and content from the Site, assumes responsibility for compliance with the legislation in force in the country of residence.

The Site contains links and banners to third party sites that are not under Vimec's control, and assumes no responsibility for the contents of such sites or for the services they provide. The Site provides these links and banners but in no way does this imply endorsement or affiliation with the linked site. The linked sites are owned by third parties that manage them individually, and therefore Vimec can not guarantee that the User will be satisfied with their products, services or business practices.

Therefore it is appropriate that the User carry out all the checks considered necessary and opportune before proceeding with any transaction with such parties.
